WHEREAS, Leonard Gilley and Kathy Gilley executed a Deed of Trust to Mortgage Electric Registration Systems, Inc. as nominee for National Bank of Commerce, Lender and Grattan Brown, Jr. and Charles A. Neale, Trustee(s), which was dated October 16, 2003, and recorded on October 21, 2003 in Book T589, Page 982, Instrument Number 88436 in Coffee County, Tennessee Register of Deeds.

WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, U.S. Bank National Association, (the "Holder"), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

View Road, Manchester, Tennessee 37355 on August 8, 2002.

Being the same property conveyed from Wayne Gilley and wife, Lois Gilley to Leonard Gilley, by Warranty Deed of record in Deed Book 289, page 500, Register's Office of Coffee County, Tennessee.
